1. GENERAL PROVISIONS

1.1. The Online Store available at www.jazgot.co.uk is operated by JAZGOT JAN KRZYWDZIK SP. K., based in Łąka (headquarters and delivery address: Łąka 260M, 36-004 Łąka); registered in the Register of Entrepreneurs of the National Court Register under KRS number 0000659637; with company documents stored at the District Court in Rzeszów, XII Commercial Division of the National Court Register; Tax Identification Number (NIP): 5170379314; REGON: 366397749; email address: sklep@jazgot.com.pl, and contact phone number: (17) 864 07 20.

1.2. These Terms and Conditions are addressed to both consumers and business entities using the Online Store unless specific provisions indicate otherwise.

1.3. The administrator of personal data processed in connection with the implementation of the provisions of these Terms and Conditions is the Seller. Personal data is processed for the purposes, duration, and based on the grounds and principles outlined in the privacy policy published on the Online Store website. The privacy policy specifies rules regarding the processing of personal data, including grounds, purposes, and retention periods, the rights of individuals, as well as the use of cookies and analytical tools in the Online Store. Using the Online Store, including making purchases, is voluntary, and so is providing personal data, except as required by law or for the conclusion of an agreement.

1.4. Definitions:
1.4.1. BUSINESS DAY – one calendar day from Monday to Friday, excluding public holidays.
1.4.2. REGISTRATION FORM – an interactive form in the Online Store enabling the creation of an Account.
1.4.3. ORDER FORM – an interactive form in the Online Store that enables placing an Order by adding Products to an electronic basket and determining the terms of the Sales Agreement, including delivery and payment methods.
1.4.4. CUSTOMER – (1) an individual with full legal capacity, or in cases provided for by law, an individual with limited legal capacity; (2) a legal entity; or (3) an organizational unit without legal personality that has legal capacity – that has concluded or intends to conclude a Sales Agreement with the Seller.
1.4.5. CIVIL CODE – the Civil Code Act of April 23, 1964 (Journal of Laws 1964, No. 16, item 93, as amended).
1.4.6. ACCOUNT – an electronic service, an individual collection of resources in the Seller’s IT system, marked with a unique name (login) and password, where the data provided by the Customer and information about the Orders placed by the Customer in the Online Store are stored.
1.4.7. PRODUCT – a movable item available in the Online Store that is the subject of a Sales Agreement between the Customer and the Seller.
1.4.8. TERMS AND CONDITIONS – these terms and conditions of the Online Store.
1.4.9. ONLINE STORE – the Seller's online store available at www.jazgot.co.uk.
1.4.10. SELLER; SERVICE PROVIDER – JAZGOT JAN KRZYWDZIK SP. K., based in Łąka (headquarters and delivery address: Łąka 260M, 36-004 Łąka); registered under KRS number 0000659637; contact email: sklep@jazgot.com.pl, and phone number: (17) 864 07 20.
1.4.11. SALES AGREEMENT – a sales agreement of a Product concluded or entered into between the Customer and the Seller via the Online Store.
1.4.12. ELECTRONIC SERVICE – a service provided electronically by the Seller to the Customer through the Online Store.
1.4.13. SERVICE USER – (1) an individual with full legal capacity, or in cases provided by law, an individual with limited legal capacity; (2) a legal entity; or (3) an organizational unit without legal personality that has legal capacity – using or intending to use the Electronic Service.
1.4.14. CONSUMER RIGHTS ACT – the Act of May 30, 2014, on consumer rights (Journal of Laws 2014, item 827, as amended).
1.4.15. ORDER – a declaration of will made by the Customer via the Order Form and directly aimed at concluding a Sales Agreement with the Seller.

2. ELECTRONIC SERVICES IN THE ONLINE STORE

2.1. The Online Store provides the following Electronic Services: Account and Order Form.
2.1.1. Account – using the Account is possible after completing two consecutive steps: (1) filling in the Registration Form and (2) clicking the "Create Account" button. The Registration Form requires the following data: name, email address, and password.
2.1.1.1. The Electronic Service Account is provided free of charge for an indefinite period. The Service User can delete the Account at any time without giving a reason by sending an appropriate request to the Service Provider, particularly via email to serwis@jazgot.com.pl or in writing to the address: Łąka 260M, 36-004 Łąka.

2.1.2. Order Form – using the Order Form begins when the Customer adds the first Product to the electronic basket in the Online Store. Placing an Order requires two steps: (1) filling in the Order Form and (2) clicking the "Buy and Pay" button. Until that moment, the Customer can modify the entered data (using the displayed messages and information available on the Online Store’s pages). The Order Form requires the following data:

  • Customer details: name/company name, address (street, building/apartment number, postal code, city, country), email address, and phone number.
  • Sales Agreement details: Product(s), quantity, delivery method and location, and payment method.
  • For Customers who are not consumers: company name and Tax Identification Number (NIP).
    2.1.2.1. The Order Form is a one-time Electronic Service provided free of charge and terminates upon placing the Order or discontinuing the process by the Service User.

2.2. Technical requirements necessary to use the Service Provider’s IT system:

  • A computer, laptop, or other multimedia device with internet access.
  • Access to an email account.
  • An up-to-date web browser: Mozilla Firefox, Internet Explorer, Opera, Google Chrome, Safari, or Microsoft Edge.
  • Minimum screen resolution: 1024x768 pixels.
  • Cookies and JavaScript enabled in the browser.

2.3. The Service User is obligated to use the Online Store in compliance with the law and good practices, respecting the personal rights and intellectual property of the Service Provider and third parties. The Service User must provide accurate data. It is prohibited to provide unlawful content.

2.4. Complaint procedure for Electronic Services:
2.4.1. Complaints regarding Electronic Services or other Online Store-related issues (excluding Product complaints covered in Section 6) may be submitted:

  • In writing to the address: Łąka 260M, 36-004 Łąka.
  • Electronically via email to serwis@jazgot.com.pl.

2.4.2. It is recommended to include the following in the complaint description: (1) details and circumstances of the issue, including type and date of occurrence; (2) the Service User’s request; and (3) contact details for response purposes. While these details are optional, they may facilitate and expedite complaint resolution.

2.4.3. The Service Provider will respond to the complaint promptly, no later than 14 calendar days from the date of submission.

3. CONDITIONS FOR CONCLUDING A SALES AGREEMENT

3.1. The conclusion of a Sales Agreement between the Customer and the Seller occurs after the Customer places an Order via the Order Form in the Online Store in accordance with Section 2.1.2 of the Terms and Conditions.

3.2. The price of the Product displayed on the Online Store's website is shown in Polish zloty (PLN) and includes taxes. The Customer is informed of the total price, including taxes, delivery costs (transport, shipping, and postal fees), and other charges during the Order placement process, including at the moment the Customer expresses their intent to enter into a Sales Agreement.

3.3. Sales Agreement procedure in the Online Store using the Order Form:
3.3.1. The conclusion of the Sales Agreement between the Customer and the Seller occurs after the Customer places an Order via the Order Form as described in Section 2.1.2 of the Terms and Conditions.
3.3.2. After the Order is placed, the Seller immediately confirms its receipt and accepts the Order for processing. The confirmation of receipt and acceptance is communicated via an email sent to the Customer’s email address provided during the Order process. The email includes at least the Seller's statements regarding Order receipt and acceptance, as well as confirmation of the Sales Agreement. Upon receiving this email, the Sales Agreement is concluded between the Customer and the Seller.

3.4. The recording, securing, and making the content of the Sales Agreement available to the Customer occurs by:

  • Providing these Terms and Conditions on the Online Store website.
  • Sending an email to the Customer as specified in Section 3.3.2 of the Terms and Conditions.

The content of the Sales Agreement is also stored and secured in the Seller's Online Store IT system.

4. PAYMENT METHODS AND TERMS FOR PRODUCTS

4.1. The Seller provides the following payment methods for the Sales Agreement:4.1.1. Cash on delivery upon receipt of the shipment.4.1.2. Cash payment upon personal collection.4.1.3. Bank transfer to the Seller’s account.4.1.4. Leasing payment – full or partial payment from leasing funds provided under an agreement between the Customer and the leasing provider, specifically:
  • PKO LEASING SPÓŁKA AKCYJNA, based in Łódź, Al. Marszałka Edwarda Śmigłego-Rydza 20, 93-238 Łódź, with a share capital of PLN 347,855,660.00 (fully paid), registered in the National Court Register under KRS number 0000022886, Tax Identification Number (NIP): 7251735694, REGON: 472191767.
  • LEASELINK SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, based in Warsaw, Al. Stanów Zjednoczonych 59, 04-028 Warsaw, with a share capital of PLN 210,600.00, registered in the National Court Register under KRS number 0000477046, Tax Identification Number (NIP): 5272698282, REGON: 146815482.
4.1.5. Electronic payments and payment by credit/debit card via PayU.pl or PayPal.com – the available payment methods are detailed on the Online Store’s payment information page (Płatności (jazgot.com.pl)) and at www.payu.pl or www.paypal.com/pl.
4.1.5.1. Transactions involving electronic payments or credit/debit cards are handled, depending on the Customer’s choice, by:
  • PayU.pl – PayU S.A., based in Poznań, ul. Grunwaldzka 182, 60-166 Poznań, registered in the National Court Register under KRS number 0000274399, Tax Identification Number (NIP): 7792308495.
  • PayPal.com – PayPal (Europe) S.a r.l. & Cie, S.C.A., 22–24 Boulevard Royal, L-2449, Luxembourg.
4.2. Payment Terms:
4.2.1. If the Customer selects payment via bank transfer, electronic payment, or credit/debit card, the payment must be made within 7 calendar days from the date of the Sales Agreement.
4.2.2. If the Customer selects cash on delivery or cash payment upon personal collection, payment is due upon receipt of the shipment.

5. COST, METHODS, AND DELIVERY TIMEFRAME, AND PRODUCT COLLECTION

5.1. Delivery of the Product to the Customer is subject to a fee unless the Sales Agreement specifies otherwise. The delivery costs (including transportation, shipping, and postal fees) are presented to the Customer on the Online Store's delivery cost information page and during the Order placement process, including at the moment the Customer expresses their intent to enter into a Sales Agreement.

5.2. Personal collection of the Product by the Customer is free of charge.

5.3. The Seller offers the Customer the following delivery or collection methods for the Product:
5.3.1. Courier shipment or cash-on-delivery courier shipment.
5.3.2. Shipment to an InPost parcel locker designated by the Customer or the nearest locker to the Customer's residence address.
5.3.3. Personal collection available at: Łąka 260M, 36-004 Łąka – on Business Days from 8:00 AM to 4:00 PM.

5.4. The delivery time for the Product to the Customer is up to 14 Business Days unless a shorter timeframe is specified in the Product description or during the Order placement process. For Products with varying delivery timeframes, the longest stated delivery time applies, which, however, cannot exceed 14 Business Days. The start of the delivery period is calculated as follows:
5.4.1. If the Customer selects payment via bank transfer, electronic payment, or credit/debit card – from the date the Seller's bank account is credited.
5.4.2. If the Customer selects cash-on-delivery payment – from the date of concluding the Sales Agreement.
5.4.3. If the Customer selects leasing payment – from the date the leasing provider informs the Seller of the agreement's conclusion with the Customer, but no later than the date the Seller's bank account is credited with funds from the leasing arrangement provided to the Customer.

5.5. Product readiness for collection – if the Customer opts for personal collection, the Product will be ready for collection within 1 Business Day unless a shorter timeframe is specified in the Product description or during the Order placement process. For Products with varying readiness timeframes, the longest stated readiness time applies, which, however, cannot exceed 1 Business Day. The Seller will additionally notify the Customer when the Product is ready for collection. The start of the readiness period is calculated as follows:
5.5.1. If the Customer selects payment via bank transfer, electronic payment, or credit/debit card – from the date the Seller's bank account is credited.
5.5.2. If the Customer selects cash payment upon personal collection – from the date of concluding the Sales Agreement.
5.5.3. If the Customer selects leasing payment – from the date the leasing provider informs the Seller of the agreement's conclusion with the Customer, but no later than the date the Seller's bank account is credited with funds from the leasing arrangement provided to the Customer.

6. PRODUCT COMPLAINTS AND WARRANTY

6.1. The basis and scope of the Seller's liability towards the Customer for a physical or legal defect in the sold Product (warranty) are governed by applicable laws, particularly the Civil Code (including Articles 556–576 of the Civil Code).

6.2. The Seller is obligated to deliver a Product free from defects.

6.2.1. Complaints must be submitted within the following timeframes, depending on the type of complaint:

  • For shortages in delivery packaging quantities – within 3 (three) days of receipt of the goods.
  • For errors in product assortment in the delivery – within 3 (three) days of receipt of the goods.
  • For discrepancies in equipment details – within 5 (five) days of receipt of the goods.

6.3. The Customer may submit a complaint, for example:
6.3.1. In writing to the address: Łąka 260M, 36-004 Łąka.
6.3.2. Electronically via email to serwis@jazgot.com.pl.

6.4. It is recommended that the Customer provide the following in the complaint description:

  • (1) Details and circumstances of the defect, particularly its type and date of occurrence.
  • (2) The Customer's request for the resolution (e.g., repair, replacement, price reduction, or withdrawal).
  • (3) Contact details for the response.

While these details are not mandatory, they may facilitate and expedite complaint processing.

6.5. The Seller will respond to the Customer’s complaint promptly, no later than 30 calendar days from the date of submission. If the Customer is a consumer and, under the warranty, requests replacement or repair of the Product, declares a price reduction, or withdraws from the agreement, and the Seller does not respond to this request within 14 calendar days, it is deemed that the request has been accepted.

6.6. The Customer exercising warranty rights must deliver the defective Product to the following address: Łąka 260M, 36-004 Łąka. If the Customer is a consumer, the cost of delivering the Product will be covered by the Seller. If delivering the Product would be excessively burdensome for the consumer due to the type of Product or its installation, the Customer must make the Product available to the Seller where it is located.

6.7. Pursuant to Article 558 § 1 of the Civil Code, the Seller’s liability under warranty for a Product towards a Customer who is not a consumer is excluded.

6.8. Warranty for electric pallet trucks:
The Seller provides a 12-month warranty for the product, limited to 1,000 operational hours, whichever occurs first, from the date of sale. A mandatory paid inspection must be performed within 6 months of the sale to maintain the warranty.

6.9. Checking for potential damage to the shipment is in the interest of the RECIPIENT. The courier company is responsible for damages occurring during transportation. The recipient may file claims with the SENDER by providing an appropriate damage report. Upon receiving the shipment, it should be inspected immediately, even if no visible external damage to the packaging is apparent. If damages are found on the packaging or the item, photographic documentation and a damage report must be prepared in the courier’s presence.

7. OUT-OF-COURT COMPLAINT RESOLUTION METHODS AND ACCESS TO PROCEDURES

7.1. Detailed information on the Customer's ability, as a consumer, to use out-of-court complaint and claim resolution methods, as well as the rules of access to these procedures, is available on the website of the Office of Competition and Consumer Protection (UOKiK) at: https://uokik.gov.pl/pozasadowe_rozwiazywanie_sporow_konsumenckich.php.

7.2. Additionally, a contact point operates under the President of the Office of Competition and Consumer Protection (UOKiK) (telephone: +48 22 55 60 333, email: kontakt.adr@uokik.gov.pl, or written address: Pl. Powstańców Warszawy 1, 00-030 Warsaw). Its role includes assisting consumers in matters related to out-of-court consumer dispute resolution.

7.3. Consumers have the following exemplary options for out-of-court complaint resolution and claim enforcement:

  • (1) Submission of a dispute resolution request to a permanent consumer arbitration court (more information is available at: http://www.spsk.wiih.org.pl/).
  • (2) Submission of a dispute resolution request to a provincial trade inspection inspector (more information on the inspector competent for the Seller’s location is available on the inspector's website).
  • (3) Assistance from a district (municipal) consumer ombudsman or a social organization whose statutory tasks include consumer protection (e.g., Consumer Federation, Polish Consumer Association). Advice is also provided via email at porady@dlakonsumentow.pl or through the consumer hotline at 801 440 220 (available on Business Days from 8:00 AM to 6:00 PM; call charges according to the operator’s rates).

7.4. At http://ec.europa.eu/consumers/odr, there is a platform for online dispute resolution (ODR) for disputes between consumers and traders at the EU level. The ODR platform is an interactive and multilingual website offering a single point of contact for consumers and traders seeking out-of-court resolution of disputes concerning contractual obligations from online sales or service agreements (more information is available on the platform or the UOKiK website: https://uokik.gov.pl/spory_konsumenckie_faq_platforma_odr.php).

8. RIGHT TO WITHDRAW FROM THE AGREEMENT

8.1. A consumer who has entered into a distance agreement may withdraw from it within 14 calendar days without providing a reason and without incurring costs, except for those specified in Section 8.8 of the Terms and Conditions. To meet the withdrawal deadline, it is sufficient to send a statement before its expiry. The statement of withdrawal from the agreement may be submitted, for example:
8.1.1. In writing to the address: Łąka 260M, 36-004 Łąka.
8.1.2. Electronically via email to serwis@jazgot.com.pl.

8.2. A sample withdrawal form is included in Annex 2 to the Consumer Rights Act and is also available in Section 11 of these Terms and Conditions. The consumer may use the sample form but it is not obligatory.

8.3. The withdrawal period begins:
8.3.1. For agreements where the Seller delivers the Product and is obligated to transfer its ownership (e.g., a Sales Agreement) – from the moment the consumer or a third party other than the carrier takes possession of the Product. In the case of an agreement that includes multiple Products delivered separately, in parts, or in batches – from the moment the last Product, part, or batch is taken into possession. In the case of regular deliveries for a specified period – from the moment the first Product is taken into possession.
8.3.2. For other agreements – from the date of conclusion of the agreement.

8.4. If the consumer withdraws from a distance agreement, the agreement is considered void.

8.5. The Seller is obligated to promptly, and no later than 14 calendar days from the date of receiving the consumer's withdrawal statement, refund all payments received, including the delivery costs (except for additional costs arising from the consumer’s choice of a delivery method other than the least expensive standard delivery method offered by the Seller). The Seller will make the refund using the same payment method used by the consumer, unless the consumer has explicitly agreed otherwise, without incurring any fees.

8.6. The consumer is obligated to promptly, and no later than 14 calendar days from the date of withdrawing from the agreement, return the Product to the Seller or hand it over to a person authorized by the Seller to collect it, unless the Seller has offered to collect the Product. The deadline is met if the Product is sent back before its expiration. The consumer may return the Product to the following address: Łąka 260M, 36-004 Łąka.

8.7. The consumer is liable for any reduction in the Product's value resulting from its use in a manner exceeding what is necessary to determine its nature, characteristics, and functioning.

8.8. Possible costs associated with withdrawal from the agreement to be borne by the consumer:
8.8.1. If the consumer has chosen a delivery method other than the least expensive standard delivery method offered by the Seller, the Seller is not obligated to refund the additional costs incurred.
8.8.2. The consumer bears the direct costs of returning the Product.
8.8.3. If the Product is a service and the consumer has explicitly requested that its performance begin before the withdrawal deadline, the consumer is obligated to pay for the services provided until the withdrawal.

8.9. The right to withdraw from a distance agreement does not apply to consumers in relation to agreements:

  • (1) For the provision of services fully performed by the Seller with the consumer's explicit consent, provided the consumer was informed that they would lose the right to withdraw once the service was fully performed.
  • (2) Where the price or remuneration depends on fluctuations in the financial market outside the Seller's control.
  • (3) For non-prefabricated Products made to the consumer's specifications or clearly personalized.
  • (4) For Products that are perishable or have a short shelf life.
  • (5) For sealed Products that cannot be returned after opening due to health or hygiene reasons if the seal was broken after delivery.
  • (6) For Products that are inseparably combined with other items after delivery.
  • (7) For alcoholic beverages whose price was agreed upon at the time of concluding the Sales Agreement but cannot be delivered until 30 days later, and their value depends on market fluctuations outside the Seller's control.
  • (8) Where the consumer explicitly requested the Seller to visit for urgent repair or maintenance; if the Seller provides additional services or goods not required for the repair or maintenance, the right to withdraw applies to these additional services or goods.
  • (9) For sound or visual recordings or computer programs delivered in sealed packaging if the seal was broken after delivery.
  • (10) For the delivery of newspapers, periodicals, or magazines, except for subscription agreements.
  • (11) Concluded via public auctions.
  • (12) For the provision of accommodation services, other than residential purposes, transportation of goods, car rental, catering, or services related to leisure, entertainment, sports, or cultural events, provided the agreement specifies a date or period of service.
  • (13) For the supply of digital content not stored on a tangible medium, if performance began with the consumer's explicit consent and acknowledgment of losing the right to withdraw.

8.10. Provisions in this Section 8 concerning consumers also apply from January 1, 2021, to individuals entering into an agreement directly related to their business activity, provided it is not of a professional nature for them, as evidenced by the nature of their business.

9. PROVISIONS FOR BUSINESS ENTITIES

9.1. This Section 9 of the Terms and Conditions and all provisions contained herein are directed exclusively at and therefore bind Customers or Service Users who are not consumers, and from January 1, 2021, for agreements concluded from that date, also do not include individuals concluding agreements directly related to their business activity if the nature of these agreements is not professional, as indicated by the nature of their business.

9.2. The Seller reserves the right to withdraw from the Sales Agreement within 14 calendar days of its conclusion. Withdrawal from the Sales Agreement in this case may occur without providing a reason and does not give rise to any claims against the Seller by the Customer.

9.3. The Seller has the right to limit available payment methods, including requiring full or partial prepayment, regardless of the Customer’s chosen payment method or the fact of entering into the Sales Agreement.

9.4. The Service Provider may terminate the agreement for the provision of Electronic Services with immediate effect and without stating reasons by sending an appropriate statement to the Service User.

9.5. The liability of the Service Provider/Seller towards the Service User/Customer, regardless of its legal basis, is limited – both as part of a single claim and for all claims in total – to the amount paid under the Sales Agreement, including delivery costs, but not exceeding PLN 1,000. The limitation of the amount mentioned in the preceding sentence applies to all claims directed by the Service User/Customer against the Service Provider/Seller, including those not related to the Sales Agreement. The Service Provider/Seller is liable to the Service User/Customer only for typical damages foreseeable at the time of the agreement and is not liable for lost profits. The Seller is also not responsible for delays in the delivery of the shipment.

9.6. Any disputes arising between the Seller/Service Provider and the Customer/Service User shall be resolved by the court competent for the Seller’s/Service Provider’s registered office.

10. FINAL PROVISIONS

10.1. Agreements concluded through the Online Store are made in the Polish language.

10.2. Changes to the Terms and Conditions:
10.2.1. The Service Provider reserves the right to amend these Terms and Conditions for important reasons, including:

  • Changes in applicable laws,
  • Changes in payment and delivery methods – to the extent these changes affect the implementation of the provisions of these Terms and Conditions.

10.2.2. For agreements of a continuous nature (e.g., Electronic Service – Account) concluded under these Terms and Conditions, the amended Terms and Conditions bind the Customer if the requirements of Article 384 and 384[1] of the Civil Code are met. The Service User must be properly notified of the changes and has not terminated the agreement within 15 calendar days of receiving the notification. In the event that changes to the Terms and Conditions result in new fees or an increase in existing fees, the Customer has the right to withdraw from the agreement.

10.2.3. For agreements other than continuous ones (e.g., Sales Agreements) concluded under these Terms and Conditions, amendments to the Terms and Conditions shall not in any way affect the rights acquired by Customers/Service Users before the effective date of the amendments. Specifically, changes to the Terms and Conditions shall not affect already placed or submitted Orders or concluded, executed, or performed Sales Agreements.

10.3. In matters not covered by these Terms and Conditions, the provisions of applicable Polish law shall apply, in particular:

  • The Civil Code,
  • The Act on Electronic Services of July 18, 2002 (Journal of Laws 2002, No. 144, item 1204, as amended),
  • The Consumer Rights Act, and other relevant provisions of commonly applicable law.

10.4. These Terms and Conditions do not exclude the provisions of the country of habitual residence of the consumer that cannot be excluded by agreement. In such cases, the Service Provider/Seller ensures the consumer the protection granted to them under the provisions that cannot be excluded by agreement.
